Accident at work and declaration by the employer

After having been notified by the employee, victim of a work accident, the employer is required, in accordance with article 2 of the Grand Ducal Regulation (RGD) of December 17, 2010, to declare the accident to the Association of accident insurance (AAA) by providing all the information requested on the prescribed form.

Law consultation

In January 2023, an insured person was the victim of a work accident following which she lost a finger. Her state of health is now consolidated, her file having been closed since April 1, 2023. In permanent partial incapacity, she requests compensation for the pain suffered and the loss of strength in the hand, heads of damage which have not been not been repaired. Working as a cook, she has problems cooking both for her employer and in her private life.

I wanted to thank you because thanks to you, I finally wrote directly myself after yet another problem with the occupational doctor. Following this letter, I had an appointment with the Director of the STM who extended my work reduction as recommended by my specialist doctor. I was finally heard and she recognized my situation. I am relieved and I will finally be able to give my body time to recover from the heavy treatments I underwent.

J'ai 38 ans et suis bénévole engagée pour AVT. La vie ne tient qu’à un fil, je peux l’affirmer. Jeune et soucieuse de mon avenir, à l'aube de mes 24 ans, je m’autorise pendant l'année scolaire à faire un break : travailler et voyager, tels sont mes objectifs. Mais une mauvaise rencontre sur l’autoroute au retour du travail a fait basculer ma vie. Mon pronostic vital est engagé suite à un véhicule en contresens sur l’A3 ce fameux 04 janvier 2009, l’autre personne n'a pas survécu … Coma artificiel, nombreuses fractures, transfusion sanguine, contusions cérébrales, et j’en passe, mon état de santé est très préoccupant pour mes proches et l’équipe de médecins. J'ai subi de nombreuses opérations et ai dû apprendre à vivre avec mes séquelles. Le soutien infaillible de mes proches et de l’équipe médicale m’ont permis d’avancer, mes différents engagements m’ont permis de grandir et d’évoluer. La campagne "Vision Zéro" m’a permise de rencontrer Josy, qui comme moi a beaucoup souffert suite à son accident de travail. En échangeant avec les autres, on se rend compte qu’un soutien d’une Association aurait été la bienvenue, tant pour le partage, pour trouver des solutions, être aiguillé. Au forum Sécurité Santé au Travail 2022, lors d’une conversation on revient sur ce sujet, on se dit que c’est le moment de se lancer. On propose le projet à nos associés, on trouve beaucoup d’idées à mettre en place, on se lance. J’aimerais vraiment pouvoir aider les personnes qui ont besoin d’une oreille qui les écoute afin de les amener à sortir de cette mauvaise passe.

Co-founder of AVT, I joined forces with Cindy and Josy to help victims of work-related accidents and illnesses. I trained as a lawyer. After obtaining a postgraduate diploma (DEA) in litigation law (Master II) from the Faculty of Law at the University of Lorraine in Metz, I worked in the courts. Initially as a legal assistant, then as a legal assistant where I dealt with labour law and social security litigation. Keen to complete my training, I took the course offered by the Luxembourg Ministry of Justice to practise in the Grand Duchy. I passed the CCDL (Cours complémentaire en droit luxembourgeois) in 2022. An association similar to AVT exists in France, but there is no structure in Luxembourg to help and support the victims of occupational accidents and diseases for the benefit of Luxembourg and cross-border workers, which is why I decided to embark on this project.
